The Regular Meeting of the Board of School Directors of the Williamsport Area School District of which all members were duly notified and of which due public notice was given as required by Act 84 of 1986, was held on Tuesday evening, April 20, 2004, beginning at 8:00 p.m. in the Board of Directors’ Room, District Service Center, 201 West Third Street, Williamsport, Pennsylvania.

 

The President, David B. Stone, Jr., called the meeting to order with the following members:

A RESOLUTION CONTINGENTLY EXEMPTING REAL PROPERTY TAX, EARNED INCOME TAX, NET PROFITS TAX, MERCANTILE AND BUSINESS PRIVILEGE TAX WITHIN A SPECIFIC GEOGRAPHIC AREA IN THE CITY OF WILLIAMSPORT DESIGNATED AS AN ENHANCEMENT TO THE #7 SUBZONE OF THE CENTRAL REGION KEYSTONE OPPORTUNITY ZONE. IN ORDER TO FOSTER ECONOMIC OPPORTUNITIES, STIMULATE INDUSTRIAL, COMMERCIAL, RESIDENTIAL IMPROVEMENTS AND PREVENT PHYSICAL AND INFRASTRUCTURE DETERIORATION WITHIN AREAS OF LYCOMING COUNTY, COMMONWEALTH OF PENNSYLVANIA.

 

WHEREAS , the Williamsport Area School District, Williamsport Pennsylvania, recognizes the need to encourage investment in areas within a defined geographical and political boundary of the City described and set forth in Attachment “A”, hereinafter the “Enhanced Area,” that is experiencing distress characterized by unemployment, low investment of new capital, blighted conditions, and underutilized, obsolete or abandoned industrial, and commercial structures, and deteriorated tax base; and

 

WHEREAS , the Pennsylvania Keystone Opportunity Zone, as amended by Act 51 of 2003, hereinafter referred to as the “Act,” authorizes political subdivisions to apply to the Pennsylvania Department of Community and Economic Development (DCED) for designation of an area within the respective political subdivision as an enhancement to a Keystone Opportunity Zone and, as a precondition of such application, to enact a binding resolution that provides within the designated and approved geographic area exemptions, deductions, abatements or credits from all local taxes identified in the Act, which resolutions will be contingent only on DCED’s approval of the application; and

 

WHEREAS , enactment of such exemption will result in improving both the economic, physical, and social conditions within the Enhanced Area by stimulating existing businesses’ employment, creating new employment and diminishing blight; and

 

WHEREAS , it is expected that increased private and public-sector investors will reverse the disinvestments and conditions of blight within the Enhanced Area; and

 

WHEREAS , the Williamsport Area School District is participating in an application to DCED via SEDA-Council of Governments seeking approval of an enhancement to the 7th Subzone of the Keystone Opportunity Zone.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of School Directors of the Williamsport Area School District, Lycoming County that effective as of January 1, 2004, until date of December 31, 2010 contingent only on DCED’s approval of the application for the enhancement of the 7th Subzone of the Central Region Keystone Opportunity Zone, the following provisions shall apply to properties listed on Attachment “A”:

 

1.   Real property in the Enhanced Area is exempt from property taxes in accordance with the provisions and limitations hereinafter set forth within the boundaries of the Enhanced Area in accordance with the Act, such exemption to run from January 1, 2004 until December 31, 2010.

 

2.   The exemption shall be 100% of the real property taxation on the assessed evaluation of properties within the Enhanced Area, known as Attachment “ A”

 

3.   Earned Income and Net Profits Taxes; Business Privilege and Mercantile Taxes . The City of Williamsport also waives business gross receipts tax for operations conducted by a qualified business; earned income received by a resident and/or net profits of a qualified business received by a resident or nonresident of the Enhanced Area Attachment “A” attributable to business activity conducted within the Keystone Opportunity Zone.

 

4.   The provisions of the Act not herein enumerated, shall, nevertheless, be incorporated as part of this resolution by reference.

 

5.   This resolution shall become effective January 1, 2004, contingent and conditioned on the approval by DCED of the application with respect to the Enhanced Area of the 7th Subzone of the Central Region Keystone Opportunity Zone.

3.   Earned Income and Net Profits Taxes; Business Privilege and Mercantile Taxes . The Williamsport Area School District also waives business gross receipts tax for operations conducted by a qualified business; earned income received by a resident and/or net profits of a qualified business received by a resident or nonresident of the Enhanced Area Attachment “A” attributable to business activity conducted within the Keystone Opportunity Zone. Occupied areas excluded in paragraph #2 are also excluded in this paragraph.

 

4.   The provisions of the Act not herein enumerated, shall, nevertheless, be incorporated as part of this resolution by reference.

WHEREAS , the Williamsport Area School District, Williamsport, Pennsylvania, recognizes the need to encourage investment in areas within a defined geographical and political boundary of the Township of Woodward described as follows: Tax Parcels #60-387-164, #60-387-157a, and #60-387-163 as shown in the attached KOZ submission prepared March 2004 by Industrial Properties Corporation, hereinafter the “Enhanced Area,” that is experiencing distress characterized by unemployment, low investment of new capital, blighted conditions, and underutilized, obsolete or abandoned industrial, and commercial structures, and deteriorated tax base; and

 

WHEREAS , the Pennsylvania Keystone Opportunity Zone, as amended by Act 51 of 2003, hereinafter referred to as the “Act,” authorizes political subdivisions to apply to the Pennsylvania Department of Community and Economic Development (DCED) for designation of an area within the respective political subdivision as an enhancement to a Keystone Opportunity Zone and, as a precondition of such application, to enact a binding resolution that provides within the designated and approved geographic area exemptions, deductions, abatements or credits from all local taxes identified in the Act, which resolutions will be contingent only on DCED’s approval of the application; and

 

WHEREAS , enactment of such exemption will result in improving both the economic, physical, and social conditions within the Enhanced Area by stimulating existing businesses’ employment, creating new employment and diminishing blight; and

 

WHEREAS , it is expected that increased private and public-sector investors will reverse the disinvestments and conditions of blight within the Enhanced Area; and

 

WHEREAS , the Williamsport Area School District is participating in an application to DCED via SEDA-Council of Governments seeking approval of an enhancement to the 7th Subzone of the Keystone Opportunity Zone.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of School Directors of the Williamsport Area School District, Lycoming County that effective as of January 1, 2004, until date of December 31, 2010 contingent only on DCED’s approval of the application for the enhancement of the 7th Subzone of the Central Region Keystone Opportunity Zone, the following provisions shall apply to properties listed on Attachment “A”:

8.4*   Approve the 2004-05 school year purchase of services agreement with Bethesda Day Treatment Center, allowing the District to place selected students at the Bethesda Center as alternative education placements.

 

8.5   Approve participation of seventh and eighth grade Roosevelt Middle School students in a research questionnaire designed by Dr. Steven Melnick (Penn State Harrisburg) and Dr. William Henk (Southern Illinois University). Data collected from Roosevelt as well as various middle schools will be used to develop a Reader Self-Perception Scale for grades seven and eight, similar to The Reader Perception Scale Dr. Melnick and Dr. Henk previously developed for grades four through six. The pilot instrument consists of 61 items, short statements that students respond to by circling either strongly agree, agree, undecided, disagree or strongly disagree. There is nothing controversial about the questions. Response is anonymous. The items ask students about their perceptions of: their personal progress in reading, how their performance compares with peers, the feedback they receive from teachers, parents and classmates, and how reading makes them feel internally. It would probably take students 20 minutes to complete. Permission would be obtained from parents before students would fill out the instrument. There is value of a Reader Self-Perception Scale for developing individual reading strategies for grades seven and eight for future middle school students in Williamsport Area School District.

WHEREAS, the Board of School Directors of the Williamsport Area School District observes with profound sorrow the untimely passing from this life of Billie Jo Cuozzo who for over three years was a dedicated food service worker for the School District,

 

WHEREAS, the Board recognizes with respect and appreciation the devotion and time she gave to her colleagues, students, parents, and family, and the consideration she always showed them,

 

WHEREAS, the tragic loss of Billie Jo will be deeply felt by many for a long time; now, there be it

 

RESOLVED: that the Board of School Directors of the Williamsport Area School District tenders its deepest sympathy to her family in their bereavement, with the comforting knowledge that her life was well spent for the good of the students and teachers she guided and for her fellow man

 

FURTHER RESOLVED: that the members of this School Board direct that this resolution be spread upon the official minutes of this body and that a copy be presented to Mrs. Cuozzo's family.

Approve released time for staff members to participate in professional development activities in accordance with the Professional Development Plan of the Williamsport Area School District and consider approving training programs. All expenditures proposed are within local, state and federal budget categories approved as noted.

 

STUDENT/COMMUNITY ACTIVITIES

 

11.1*   Approve the following student trips:

 

A.   Ninety-six (96) first grade students from Jackson Elementary School, accompanied by their teachers and a paraprofessional, to travel to Penn’s Creek (Mifflinburg) during May 2004 as a culminating activity for their units in biology and ecology. The students will also have the opportunity to have a picnic. District transportation is requested. All costs will be paid by the Jackson PTO.

 

B.   Eighteen (18) members of Curtin Middle School’s jazz band, accompanied by two teachers, to travel to Brandon Park during April 2004 to perform. The students will walk to and from the park.

 

C.   Sixty-nine (69) second grade students from Stevens Elementary School, accompanied by their teachers, an aide, and six parent volunteers, to travel to the Montour Preserve during May 2004. Students eligible to participate must be in compliance with the school’s field trip disciplinary requirements. District transportation is requested. All costs will be paid by the Stevens PTA.

 

D.   Fifty-two (52) third grade students from Sheridan Elementary School, accompanied by their teachers, to travel to the Montour Preserve during May 2004. Students eligible to participate will not have will not have received two pink slips, one major pink slip, one detention, one Saturday School, or one out-of-school or bus suspension between April 13 and the date of the trip. District transportation is requested. All costs will be paid by the Sheridan PTO.

 

E.   Twenty-five (25) members of the Williamsport Area High School’s percussion ensemble, accompanied by their teacher and six chaperones, to travel to Wildwood, New Jersey, for three days during April and May 2004 to participate in the Percussion Ensemble TIA Championships. Students eligible to participate will not have been suspended from school more than five days; will have no bus disciplinary record; will be passing all major courses; and are not, in the judgment of their house principal, experiencing attendance difficulties. Transportation will be provided by contract carrier. All costs will be paid by the WAHS Band Association.

 

 

 

 

 

 

11.1*   Approve the following student trips cont’d:

 

F.   Sixty (60) Williamsport Area High School students, accompanied by their teachers and counselors, to travel to Lycoming College during May 2004 to attend a job fair. Students eligible to participate will not have been suspended from school more than five days; will have no bus disciplinary record ; will be passing all major courses; and are not, in the judgment of their house principal, experiencing attendance difficulties.

District transportation is requested (10-1390-519-000-30-850-280-033-0000). Two substitutes will be needed for the day.

 

G.   Approximately 75 third grade teachers from Cochran Elementary School, accompanied by their teachers and an aide, to travel to the Montour Preserve during May 2004. Students who have received a pink slip or three seminars, have been suspended, or who have been assigned to Saturday school from April 6, 2004, through the date of the trip will be unable to participate. Exceptions may be made at the discretion of the principal. District transportation is requested. All costs will be paid by the Cochran School Association.

 

H.   Approximately 10 emotional support students from the Williamsport Area High School, accompanied by their teachers and an aide, to travel to Rock Run and Pleasant Street on dates in April and May 2004. Students eligible to participate will not have been suspended from school more than five days; will have no bus disciplinary record; will be passing all major courses; and are not, in the judgment of their house principal, experiencing attendance difficulties. District transportation is requested. A private vehicle may be used to supplement district transportation if needed.

 

I.   Twelve (12) additional events for the Williamsport Area High School’s Strolling Strings taking place in April through December 2004. A copy of the schedule of events is attached.

 

J.   Revision to item 11.1W from the April 6, 2004, Addendum: One (1) additional Williamsport Area High School FBLA student, accompanied by his advisor, to travel to Denver, Colorado, for seven days during July 2004 to compete in the FBLA National Competition. There will be an additional $200 expenditure for the extra participant (10-1390-519-000-30-850-280-033-0000).

 

K.   Approximately 9 students (per group) from the Alternative Education Program, accompanied by two teachers, to travel to an area stream on dates during April and May 2004 to learn about fish stocking.
